Ohio Politician Resigns, Pleads Guilty of Obscenity.

Cuyahoga County Recorder Patrick O'Malley resigned from his political office Thursday, just hours before he accepted a deal with federal prosecutors and pleaded guilty to a federal obscenity charge. O'Malley told reporters the obscenity charge had "absolutely nothing to do with any ‘kiddie porn' allegations." The plea in federal court in Akron, Ohio, capped nearly four years of speculation after FBI agents raided O'Malley's Chagrin Falls home and seized two computers. A search warrant revealed that the agents were looking for images of child pornography and records related to a billboard deal that involved the city of Cleveland and was brokered by O'Malley.

Judge Vincent Gaughan did say however that the trial transcripts would be released to the media following the conclusion of the trial. Engineering Smarter Landing Pages.

Not all landing pages are created equal. How well they convert rests solely on how well you engineer them. Lets discuss thought, design, engineering, and how they make a difference. Smarter landing pages are 'human friendly.' They're based on what is known about people and what people like and don't like. And that knowledge isn't arbitrary. It's based on research, marketing testing...facts. In a certain sense your landing pages should be unobtrusive. Your potential customer should feel so relaxed and satisfied with the 'overall' that she just naturally wants to know more and clicks through to your vendor's site.

Overstock.com Takes Stand Against NY Sales Tax.

Online retailer Overstock.com sent out a note yesterday to some 3,400 New York -based advertisers, stating that as of June 1st, the site will no longer accept their advertising--at least until the New York State Internet tax that goes into effect on that date is repealed. "We love New York," said the site's chairman and CEO, Patrick Byrne, "but New York's new tax law required us to choose between New York customers and New York ad businesses. In the end, we chose our customers. The governor and legislature of New York should understand that a tax is a price that a government charges for a service, and when the price of anything is raised, people (including us) buy less of it."

Porn again Penthouse buys born again BigChurch.com website.

It is one of the most implausible hook-ups on the internet - a popular Christian dating website, BigChurch.com, is now part of the online family of the Penthouse Media Group. Its raunchy bedfellows in the porn company's cyber publishing empire include other dating sites such as AdultFriendFinder.com ("the world's largest adult sex and swingers site") and Bondage.com (no explanation necessary). The financially-struggling Penthouse group recently moved into the social networking world after its old core magazine business was undermined by the explosion of pornography on the internet.

Sarasota Club Wins Concessions in New Adult Law.

The owner of Sarasota's only strip club managed to get the majority of proposed restrictions removed from a new adult ordinance passed Wednesday, but may still challenge it. Ken Tatarow, owner of the Cheetah Lounge, has twice packed the Sarasota County Commission chambers with strippers and other supporters opposing the law, and is still concerned about a provision that remained intact requiring that dancers only perform on stages. "That could be a major problem," Taratow told the Sarasota Herald-Tribune. "But everything else I can live with."

Government orders data retention by ISPs.

Phone and internet companies will soon be forced to keep logs of internet usage to be made available to the police under a new law announced by Prime Minister Gordon Brown this week. The law, the Communications Data Bill, will implement the remainder of the European Union's Data Retention Directive. Last October the Government enacted regulations which said that telcos must keep records of phone calls to and from land lines and mobile telephones. That requirement will be extended to records of customers' internet usage, email usage and voice over internet protocol (VoIP) records. “The aim of the [Directive] is to ensure that certain data is retained to enable public authorities to undertake their lawful activities to investigate, detect and prosecute crime and to protect the public," said a Home Office spokeswoman.“The first part of the [Directive] was transposed into UK law in October 2007 but the Government made a declaration … to postpone its application to the retention of communications data relating to internet access, internet telephony and internet email until 2009. So the measures referred to in the Communications Data Bill will complete the transposition of the Directive for IP [internet protocol] communications data," said the Home Office spokeswoman.

Malware Targets Porn Surfers on Mac OS.

The last bastion of safe porn surfing is now gone as a new piece of malware is now targeting Mac users with an inclination to watch porn. A Mac security company called Intego issued a warning on Wednesday to Mac users of a malware, OSX.RSPlug.A which is basically Trojan. It disguises itself as a video codec that ensures whatever porn video the user just stumbled on will actually play on the user's Mac. In order to infect the user system, the user must accept the invitation to download the "new version of the codec", open the disk image file (.dmg), click the installer.pkg file, and enter the administrator's password. But once infected, the Trojan changes the machine's DNS settings to hijack web traffic and redirect it to phishing sites or other porn ads. Oh, and by the way, you still don't get to watch the video.

Radio and Web Video - Together at Last.

Well look who finally got to the party. I have been a web video producer for over three years and a video producer for over ten. Gone are the days of multiple DVD duplication to be distributed via direct mail. Most of us recognize the powerful potential of web video, and heaven knows, we have all seen the success radio can have for an advertiser. Maybe you have tried radio with limited or faint results, and maybe you have delayed upgrading your web presence with video. I'm sure you have your reasons. Running a business is challenging enough, and some of us small business owners just have too many questions to simply jump in and hope the pool is deep enough. Now we are going to be affronted with economic doom and gloom. Another distraction that will enable us to sit still, paralyzed by fear, when we know something regarding our marketing efforts has to be done.

Can the Feds enforce Net neutrality? Maybe not.

Federal regulators may be probing Comcast's throttling of BitTorrent filesharing traffic, but can they actually take action, if they choose, against the company or any other broadband provider on Net neutrality grounds? The answer may not be simple. And if the FCC and other regulators are really powerless--in other words, if they need Congress to enact new laws--it means that any threats to take action against Comcast, based on alleged violations of the law today, are merely empty ones. That's the issue that former staffers and officials from the Federal Communications Commission and Federal Trade Commission took up at an event here on Thursday.

Washington State Ban on Online Poker.

Lee Rousso presented his arguments yesterday in court regarding the unconstitutionality of the state of Washington's ban on playing online poker, but the judge did not agree, so the ban making playing online poker a Class C felony remains in force. The state ban, which was passed in 2006, prohibits Internet-based card games such as Texas Hold'em that poker players in Washington have used to qualify for large prize pool tournaments played both live (like the World Series of Poker) and online. Other persons convicted of a Class C felony in the state of Washington include those guilty of possessing child pornography, stalking, drive by shootings, threatening the governor, family abandonment, heroin possession, unauthorized abortions or committing grand theft auto. The same punishment for playing online poker has been criticized as excessive by many state residents. Lee Rousso, lawyer, former gubernatorial candidate and Poker Players Alliance (PPA) regional director for the state of Washington, originally filed the lawsuit on the first day of the 2007 World Series of Poker Main Event, and has traveled a long legal road to finally get his day in court.

But where do you look to find the amount of RAM currently in use? Or the amount of free storage on your hard drive? Or how long your PC has been on? You'll find this and similar system information in various nooks and crannies of Windows' settings dialog boxes, or you could get it all in one place with Sepanta Soft's Easy Vista Manager and Easy XP Manager utilities.

Legal liability for YouTube viewers.

Users of YouTube and other video-sharing sites could face $750 per clip penalties if they have watched a video that was uploaded without the copyright holder's permission. Copyright infringement in the United States strict liability offense. What this means, is that users are liable when they illegally copy works, even if they're not aware that this is wrong, or that the work is protected by copyright. As an example, let us consider the popular video sharing website YouTube. Every week, 6 days after the show airs, HBO uploads the most recent episode of "Real Time with Bill Maher." However, within a few hours of the show's TV broadcast, a number of other users upload copies that they have recorded with their computers. When a user visits YouTube, and searches for "Bill Maher", he will see a large number of results - some of which will be for official content uploaded by HBO, and the vast majority of which is for copyrighted content illegally uploaded by other users. According to a strict reading of the copyright laws, and discussions with legal scholars, users could unknowingly be liable if they click on the wrong YouTube link. The fact that they're not aware that a video was illegally uploaded is irrelevant. All that matters is that they clicked on a link, and watched the video.

Why People Buy.

Selling products or services, it is important to understand why people buy. Marketing, sales, operational infrastructure, and customer service should be crafted with the consumer purchasing perspective. First, we need to distinguish between why people buy, and why people buy from you. Typically, consumers make a decision to buy, before making the decision on which one to buy, or who will make the sale. Most organizations continually refine the process of studying consumer demographics to understand position in comparison to the competition. In other words, the organizations study why a consumer will buy from them, as opposed to the competition. Design, features, marketing messages, and sales plans are organized to differentiate from the current competition. To take a step ahead of the competition, focus first on the fundamental moment of truth, the point at which the consumer makes the decision that an investment or purchase is worthwhile. Before you can answer the question of "why you", you must first answer the question, "why buy"?

Would porn production run away?

In recent years, legislators have looked at ways to stop film and TV studios from moving their production to other states. Now opponents of a new bill say a legislator could run an even bigger industry out of California. AB 2914 is the third attempt by Assemblyman Charles Calderon, D-Whittier, to impose a tax on adult businesses. Reached on Wednesday, Calderon said that his office is looking to clarify the language. But the final language will keep a 25 percent tax on both the sale and production of adult materials, he said. The total tax on any one DVD or magazine, he said, would be capped at 50 percent. During a press conference on Monday, Calderon said that the production of adult materials won’t leave because only California has a friendly-enough legal environment. He cites a 1982 California Supreme Court case, State of California vs. Harold Freeman. The court ruled that the production of adult films did not constitute pandering—pimping, in more colloquial terms—and is therefore legal. No other state has this legal precedent, Calderon said.

Debate Rages Over Porn At Libraries.

Public libraries have always been great places for learning, but parents who use several Brooklyn libraries said their children are learning too much as adults nearby look up racy materials while surfing the Internet. At the Brooklyn Public Library, the policy is simple: Kids use computers in one room and adults use equipment in another. And while nothing stops children from using the adult terminals, kids are restricted to logging on with a card that filters out adult Web sites. “I think it’s good,” Tyler Centeno of Park Slope said. “So we don’t go on anything inappropriate and stuff like that.”But Dr. Susan Fox, who runs an online community of 6,000 members called Park Slope Parents, said many parents have complained recently about what adults view at the library.

9 Tips for Creating a Site Map for Visitors and Spiders.

Not every site needs a site map, they can certainly be a good idea. Site maps provide a dual purpose: They provide search engine spiders easy access to all of your site pages and they provide site visitors easy access to all of your site pages. The difference is that search engines and visitors access your site map differently and therefore there are different methods that need to be applied to creating site map(s) that are friendly for both engines and search spiders. Small sites typically don't need a site map so long as all pages are linked in the main navigation. Once you get into main and sub-navigation menu's then site maps are helpful in allowing search engines and visitors to quickly find anything they are looking for within just a couple of clicks. A single site map can be used for both purposes or multiple site maps can be created. Here we'll address creating site maps for spiders and humans separately.

Marriott Meets with Groups Opposed to In-Room Porn.

Don Wildmon, chairman of the American Family Association, one of 47 pro-family groups lobbying Marriott International to make its properties porn-free, said the first face-to-face meeting with representatives of the hospitality giant on Wednesday was "productive." "I think we had a productive meeting," Wildmon told Cybercast News Service, "a good first step. We came away with two things that are going to be looked into and we'll meet again in six weeks." Wildmon said Marriott officials agreed to look into whether a change can be made in their contract with Lodgenet, the largest provider of in-room entertainment systems and content in the country, to make pornography inaccessible in rooms unless the guest requests it. "That would take I'd say about 80 percent of their sales away," Wildmon said, "because the vast majority of people would be too embarrassed to call the front desk and say I want the adult channel."

Many organizations are decreasing their reliance on user names and passwords for user authentication. They are also learning more about the benefits of deploying strong user authentication to increase the level of assurance for online identities as part of an overall approach to securing access to information and managing risk. Companies should select and deploy strong user authentication solutions based on their assessment of the optimal balance between security , total cost of ownership (TCO) and alignment with the end-user populations and applications being supported. The Problems With Passwords Aberdeen's research indicates that virtually all organizations surveyed (98 percent) indicate continued reliance on user names and passwords for authenticating end users to control access to systems, networks, data and applications. Nearly half (48 percent) of all respondents, however, have also deployed at least one stronger, non-password method of user authentication.

Spammers open new front on social networking sites.

Social networking sites have become the new front in the war against spam, according to security watchers. In the six months leading up to March 2008, social networking sites saw a four-fold growth in the amount of spam on their network. At several major social networking sites, 30 per cent of new accounts created are automated fraudulent 'zombie' accounts, designed to be used for spam and other malicious attacks, according to anti-spam firm Cloudmark. JF Sullivan, VP of marketing at Cloudmark, said the type of spam advertised through social networks is the same type as that advertised by email spam and punted by much the same people. "There's an implicit trust in social networking. People don't think they're going to be attacked with spam," Sullivan told El Reg. "People don't trust email anymore. Spammers are following peoples' online habits."Mobile spam, by contrast, is sent by different group of individuals. Social networking spam can be messages between users or posts to walls or other similar applications. Social network spammers most often hijack accounts using fake log-in pages. Phishing-like tactics, password guessing and the use of Trojans to capture keystrokes are also in play.

Sex-shop owners fighting proposed California 25 percent tax.

Sex shops and strip clubs would have to pay an extra 25 percent tax on their sales and services under a proposed state law meant to offset the costs of allowing such businesses into a community. But California's $4 billion-a-year adult industry has attacked the proposal by Assemblyman Charles Calderon, D-Montebello, as unconstitutional and based more on opinion than on fact. Adult-business owners in Orange County say the tax would put strippers out of business and break sex shops that already must abide by strict rules about where they can operate. "I don't know how this business has any kind of bad reputation," said Jerry Tatarian, the manager of the Flamingo Theater, a strip club in Anaheim. "You walk in here on your own free will. We don't show anything outside. We're just a regular business." "Twenty five percent?" he added. "What's he trying to do, become a partner?"

Police say man filed false report to evade porn fees.

John M. Butler complained to Naperville police when he started getting billed for adult entertainment services offered over the Internet, services he insisted he had never used.Police say Butler has been exposed as a liar. The 28-year-old supermarket meat cutter now faces trial in DuPage County Circuit Court in Wheaton on misdemeanor charges of theft and filing a false police report. Butler went to police Jan. 14 and filed a formal report, alleging he had been the victim of identity theft, police Cmdr. Dave Hoffman confirmed. Butler at the time was living at 314 Weatherford Lane in Naperville's Old Farm neighborhood, but has since moved to near-west suburban Countryside. He claimed an unknown third party had obtained his debit card number or gained access to his bank account and made more than $500 worth of fraudulent charges at adults-only entertainment sites on the Internet, Hoffman said. Police believe Butler "made the charges himself and was trying to get out of paying" for them, he said. Butler was arrested May 2 at his new home in Countryside. He is scheduled to appear in court June 3.

Personal devices get hardcore.

The next time you're waiting in line at the DMV and see someone furiously clicking on his cell phone while rooting in his pocket, there may be more going on than you think. Recent improvements in WAP bandwidth have given us a perfect storm for video porn on your phone. Getting porn over Wireless Access Protocol, or WAP, is not new, but it's recently been booming with the widespread implementation of broadband wireless data transmission technologies like EDGE (used by AT&T and T-Mobile) and EvDO (Sprint, Verizon, and Alltel).

What You Must Know About Text vs. HTML Emails.

HTML messages allow for text formatting, multiple columns, images, and brand recognition. They are growing in popularity and over 95% of customer email programs today will support HTML email. Unfortunately most spam is also formatted using HTML and thus differentiating between requested email and HTML spam messages can be difficult. HTML emails are therefore more likely to trigger spam filters. According to email deliverability expert Dori Friend, you should never use HTML email. Dori's advice is supported by some studies. A 2004 study by AWeber.com shows that plain text messages are undeliverable 1.15% of the time and HTML only messages were undeliverable 2.3% of the time. But on the other hand we have seen tests were they changed from html to plain text and the open rates dropted with over 15%.

Korean 'War Against Pornography' Starts.

Portal Web sites or peer-to-peer program managers will be obliged to screen out pornographic material while those uploading such video clips with IP addresses overseas will be censored. Also, more surveillance cameras will be installed at schools to watch over possible sexual assaults and the government will provide software blocking such lewd material online, the Ministry of Education, Science and Technology said Wednesday. The plan is part of the government's projects to fight against lewd material on television, the internet and elsewhere in order to prevent children from accessing sexually explicit content that sometimes leads to sex crimes. The government is cracking down on online pornography distributors with 3,300 experts investigating user-created clips and other video material by the end of the month. Also, more counselors will be placed at schools to talk about sexual problems with the students from July. The education authorities said more than 234 billion won of budget will be allotted for the plan.

Girls Love Gay Male Porn.

I just got back from a weekend at the University of California at Santa Barbara, where I attended "Console-ing Passions: An International Conference on Television, Audio, Video, New Media, and Feminism." A bunch of women stuck around afterwards to continue the discussion that the panel had, um, stimulated, and we began talking about the kind of porn we all watched. Someone brought up the work of Shine Louise Houston's Pink and White Productions (pinkwhite.biz), a San Francisco–based company that describes its mission as creating "adult entertainment that exposes the complexities of queer sexual desire . . . dedicated to producing sexy and exciting images that reflect today's blurred gender lines and fluid sexualities." She thought it was amazing; I chimed in and said, "Yes, it's diverse, radical, and I totally applaud Houston's vision."

Web Facing Malware Rampage.

Trend Micro has identified over half a million Web pages that have been compromised by a Web attack. Affected websites are injected with a malware script (JS_SMALL.QT) resulting from a poor PHP Bulletin Board (aka, phpBB), a popular Internet forum software program, implementation. Upon visiting affected websites, visitors are infected with a variant of the ZLOB family (TROJ_ZLOB.CCW) which poses as a video codec installer. When users download the purported video codecs they are actually downloading several Trojan horse programs: TROJ_DNSCHANG.CS TROJ_ALUREON.AE TROJ_ALUREON.AH TROJ_ALUREON.AI These types of Trojans change an affected system's DNS server and Internet browser settings, thus making the system vulnerable to additional threats. The malware is hosted on servers located in in the US and Moscow. This attack is potentially the work of a Russian/Ukranian criminal gang that have initiated previous ZLOB attacks over the course of the past year.

Ask.com Search Engine - A Brief History.

After twelve years on the scene, the Ask.com search engine is trying to stand its ground. Over its years as one of the top Internet search engines, Ask.com has shown continuous innovation in search. Two of the Internet’s big contenders -- Yahoo! and Google -- are in a race to be the best, and Ask.com has struggled to keep abreast of their movements. The future of the company ultimately depends on Ask.com finding a niche or a suitable direction. As of this writing, there are five top Internet search engines: Google, Yahoo!, MSN, AOL, and Ask.com, and while Google and Yahoo! get a lot of the press (particularly lately), the Ask.com search engine is a rather interesting engine that deserves a closer look. This article will cover some of the highlights in its 12-year history, from its start as Ask Jeeves to its innovations, as well as the most recent developments behind the scenes.

Porn shop appeals movie X-rating.

Online business Adultshop.com today appealed against the failure of its legal bid to reduce the X rating given to an adult film. In November last year, Justice Peter Jacobson dismissed the online store's application for a judicial review of the Classification Review Board's decision to rank the film Viva Erotica as X18+. For a film to fall under this classification it must contain ``real depictions of actual sexual activity ... in a way that is likely to cause offence to a reasonable adult''. Adultshop.com had argued films that show intercourse between two consenting adults should carry a rating of R18+, meaning it could legally be sold across Australia. It claimed Viva Erotica and other films of this nature, do not offend reasonable adults and the board's decision did not reflect current community standards.

MySpace wins $230m judgement against spammers.

An American court has made a landmark ruling in favour of MySpace in a case that will send shivers through the spamming community. US District Judge Audrey Collins has awarded MySpace a record $230m in a case against two US-based spammers. Sanford (or "Spamford" as he is frequently called) Wallace and his partner Walter Rines were not there in court as the judge handed down what is claimed to be the largest ever judgement in an anti-spam case. The judge found the duo guilty of orchestrating a phishing scam, which was designed to harvest MySpace login credentials. They then bombarded members with messages advertising gambling and porn websites. According to Associated Press, as many as 730,000 bogus messages were sent to MySpace members - many of whom were fooled because they were designed to look like MySpace messages from friends. MySpace claimed that there were hundreds of complaints and it also had to foot some "delivery-related costs". In the meanwhile, the spammers apparently netted around $555,850 from the start of the campaign in late 2006.

Poor Porn Sales: Another Sign Of Recession?

Recession is a dirty word especially in the porn industry. Sales of videos are down double digits for the first time in 40 years. Some believe that a decline in this once recession-proof business, could be an indication of a decline in overall consumer confidence. So is porn going soft? According to Adult Video News, the industry's leading trade publication, DVD sales fell 11-percent in 2006. This year, it's closer to 30-percent. Economics professor Robert Gustafson said that's very unusual for this industry. "We're seeing this happen for the first time where you have the adult world actually in their own form of a recession," Gustafson told CBS station WFOR-TV in Miami. Competition from the internet has also cut into profits. Consumers are hooked on pornographic knockoffs of You Tube, like Your Porn, the world's number one porn site, which offers free uploads of adult entertainment videos. Hustler president Michael Klein said while DVD sales may be down, his stores, magazines, and casino are doing well. In fact, Hustler is now marketing the brand on cell phones. "Despite the economy and being in a recession people still find ways for entertainment and adult entertainment is usually affordable," said Klein. According to Professor Gustafson these obscene losses won't last long.

ISP content filtering still on the agenda.

While federal budget contains expected funds for promised broadband infrastructure projects, it reminds us of the Federal Government's plan to implement ISP-level content filtering. "Central to the Government's plan to make the internet a safer place for children is the introduction of Internet Service Provider (ISP) level filtering of material such as child pornography", said a media release from Senator Conroy's office today. "The ISP filtering policy is being developed through an informed and considered approach, including a laboratory trial, extensive industry consultation, and close examination of overseas models to assess their suitability for Australia."The original announcement garnered significant criticism from industry participants, with most believing it would be ineffective at blocking the intended content, and that it would likely increase costs and slow broadband speeds. But the wording of today's announcement suggests that the end result may not be as dire as first thought. "ISPs in a number of European and other countries are already filtering child abuse material", said Conroy. Indeed, the system in the UK attempts to filter out child pornography, but it does this with a simple IP blacklist, reported to contain just 1000 sites. The government continues to confuse the issue however, often stating that it will protect Australian children by blocking access to child pornography, but doesn't clearly state it will attempt to block all pornography.

Site Development     Tuesday, May 13th 2008, 12:03pm EDT

Web-Content Conundrum.

The Web consumes content like a teenager at an all-you-can-eat buffet. Lots and lots of content makes you more search engine friendly, helps establish your knowledge and expertise, explains in detail what you offer, and justifies that offer with all the explanations, statistics, and rationale you can muster. The problem is nobody reads it. Well that's not exactly true: some people read every scrap of information on your site; they just happen to be the tire-kickers, the people looking for ways to get stuff they don't have to pay for, or they're competitors looking for ways to copy what you do, or worse find something wrong. This is definitely a dilemma that needs to be addressed.

Pornography law could bring unwarranted scrutiny.

In 2005, the Lion’s Den bookstore opened its doors alongside Interstate 65 near Uniontown in Jackson County. Before opening, the bookstore reportedly never gave indication that it would sell adult material. Pornography opponents stood outside the store round the clock to protest. Many cities and towns have ordinances to regulate those kinds of retailers. But in this case, the store was in an unincorporated area that has no zoning restrictions. The case sparked state Rep. Terry Goodin, D-Crothersville, to create a bill regulating the retail sales of adult material. His House Bill 1042 becomes law July 1. A business intending to sell sexually explicit materials, products or services will have to register and file a statement with the Indiana Secretary of State. The Secretary of State is then supposed to forewarn county officials. The filing fee is $250 and goes into the state’s general fund. Selling sexually explicit material such as pornography without proper registration could result in a Class B misdemeanor charge. A Class B misdemeanor can result in up to 180 days in jail or up to $1,000 in fines. “We have to send a message to retailers that there is more than porn in Indiana,” Goodin said during a House hearing on his legislation.

Court papers: Kerekes talked of Kocis killing.

Once he was in jail, homicide suspect Joseph Kerekes talked – a lot – according to court papers filed recently by Luzerne County prosecutors. He told one cellmate how he and Harlow Cuadra conspired to kill a “dude” to gain the movie rights of a porn star, according to the documents. He talked of how he and Cuadra looted the residence of Bryan Kocis after Cuadra stabbed Kocis 17 times and they both slit his throat. And how they had to burn Kocis’ house because it was “too bloody” to clean, the court papers say. He allegedly told the inmates how he used his cell phone and computer at a Plains Township motel to ensure he had an alibi – and he planned on steering blame in the death on Cuadra. Those papers detail the alleged statements Kerekes made to inmates after he was jailed last year in the slaying of Kocis.Police say Kerekes, 34, and Cuadra, 26, both of Virginia, killed Kocis, their rival in the gay porn industry, inside his Dallas Township home in January 2007 then set it on fire. Kocis, 44, was found dead by firefighters.

Texas to force Amazon into sales tax collection?

Reportedly inspired by an ongoing legal skirmish in New York, tax officials in Texas are investigating whether Amazon.com should be collecting sales taxes from the Lone Star State's residents. According to recent reports in the Dallas Morning News, the Texas Comptroller's office is currently looking into whether the Seattle-based e-tailer can be held responsible for paying as many as four years' worth--potentially millions of dollars--of back taxes. Some Texas officials said they weren't aware that Amazon had been operating a distribution center in Irving, Texas, since 2006, until receiving a call from a Morning News reporter last week.

Porn Tax Opposed by Republicans.

At the outset I would admire Republicans protecting sex toys, stripers, and adult movies, but it’s more to do with opposing taxes. California Assembly Democrats are mounting up against the porn industry. Like it or not the industry of sin brings in millions of dollars to California, it has a big employee base, and already collects revenue from taxpaying home owners. The argument against Assembly Bill 2914 is that it will drive the porn industry out of California, along with all its tax payers. Adult entertainment star Kayden Cross will be testifying against the bill. I believe Legislatures in Sacramento are going to end up hurting rather than helping the dismal California budget crisis. Rather than bilking businesses, legislatures must stop the hemorrhaging of all the wasted tax dollars. Let’s see a massive overhaul in government waste, more accountability, and less punishment in the form of excessive unwanted tax.Maybe the “Bible thumpers” will enjoy the attack on this industry, but maybe the religious industry had its tax breaks long enough, how about a prayer tax?

It is titled "Internet Usage and the Exposure of Pornography to Learners in South African Schools". Among other major findings is that 64 percent of teenagers surveyed had been exposed to pornographic images on the internet, while 81 percent admitted to seeing such images on friends’ cellular phones.

XP update throws some for a loop.

Owners of some AMD-based computers are finding that the move to Windows XP Service Pack 3 has sent their systems into an endless reboot cycle. "Microsoft issued guidance to OEMs advising them to only load Windows XP images onto like hardware in 2004." The issue was noted late last week on Microsoft forums and by others, including ZDNet's Mary Jo Foley. Those with a problem are encouraged to contact Microsoft's customer support. The reboot cycle glitch is the latest hiccup for Microsoft with the service pack update. The company had to delay the release of the XP update after discovering at the 11th hour an incompatibility with one of its own programs.

Texas Tax Man May Cometh for Amazon.

Texas may soon follow in the footsteps of those clever New Yorkers, asking Amazon for some serious sales tax dollars. Or maybe not. Currently, Amazon does not collect sales tax on goods shipped to the Lone Star State. But as reported by The Dallas Morning News, the Texas comptroller is considering whether this situation needs changing. The state may even ask the mega e-tailer for millions of dollars in back taxes. A 1992 Supreme Court decision says that American e-tailers are required to collect sales tax if they have a "physical presence" in the state where a customer resides. And according to company spokeswoman Patty Smith, Amazon does indeed have a physical presence in Texas - and it has for at least seven years. "One of subsidiaries opened a fulfillment center in Irving, Texas in 2006," she told us. "And we've had other operations in Texas since 2000." According to The Dallas Morning News, the Texas comptroller was unaware of this. "In conversations with Amazon, they told me they don't have a distribution center in Texas," Robin Corrigan, of the comptroller's office, told the paper.

It happens sometimes. Here are some of the common reasons you may not be indexed: Index Time: It hasn't been indexed yet. The amount of time before the engine indexes your site should be listed on the search engine's submission page, but these aren't always accurate or may be out of date. On the average, index times range from one to eight weeks depending on the engine. Some engines like AltaVista and Inktomi offer paid options if you wish to be indexed more quickly. Tip! Time frame and expectations: Allow up to 4 months, if you are number 10 and want to be number 1, then it may just be time that is needed - but if you aren't showing up at all, then you need to look at keywords, content, title, description and keyword tags.

Porn site to the rescue for Spanish wives.

It could be the plot of a film by Pedro Almodóvar, but the dimpled flesh and slightly crooked smiles make it all too real. The good housewives of Serradilla del Arroyo, a remote Spanish village with a population of just 400, decided to raise money to build a children's leisure centre last autumn by stripping for a saucy calendar. The month of December 2008 showed the señoras posing together, wearing little more than tinsel and elf hats. Other months showed a wife holding a rifle and covered with furs, while a third showed the baker's wife lying provocatively before her oven, cakes placed strategically before her.Sadly, the seven brave mums of Serradilla overestimated how popular their racy calendar would be. They managed to sell 1,500 copies to sheep-faced husbands and slightly embarrassed relatives in the surroundingvillages. But 5,500 remained stubbornly unsold. Last month, the printer sued the women to recover the outstanding €9,000 - plus €18,000 in damages. The news triggered an outpouring of sympathy throughout Spain. Fortunately, help was at hand this week from an unexpected source: a Spanish internet site specialising in home-made porn. On its site, Fisgon.com said it would pay off the debt because “such a good idea for such a noble cause did not deserve to end this way”.Mrs Garín said they had initially harboured reservations about accepting the money from a porn site. “But independently of what they do, this company has been wonderful to us. If we have to do it again,” she said, “we'll do it.”

House Democrats Dig Up Decades-Old Antitrust Law in New Net Neutrality Fight.

The long-running debate over net neutrality took another turn Thursday when two lawmakers introduced a bill that would make it a violation of antitrust law for broadband providers to discriminate against different types of content in routing traffic on their networks. John Conyers Jr., a Democrat from Michigan who is also chairman of the House Judiciary Committee, and Rep. Zoe Lofgren, a California Democrat, introduced the "Internet Freedom and Nondiscrimination Act of 2008."The legislation would require that Internet service providers (ISPs) interconnect with other network access providers "on a reasonable and nondiscriminatory basis" and that they take a similar approach to assure that all content, applications and Web services are treated equally. "Americans have come to expect the Internet to be open to everyone," said Conyers. "The Internet was designed without centralized control, without gatekeepers for content and services. If we allow companies with monopoly or duopoly power to control how the Internet operates, network providers could have the power to choose what content is available. Many of the innovations and products we use every day, such as search engines, music download services and online video, likely would never have developed in such a restricted environment." Recent events have made the need for such a move more urgent than ever, commented Lofgren. "We need a meaningful remedy to prevent those who control the infrastructure of the Internet from controlling the content on the Internet."

How ComScore can track your mouse clicks.

There's one question no one thought to ask: How did comScore know that all those paid clicks had disappeared from the world's largest search engine? In late February, the well-known web research outfit unveiled a particularly juicy report claiming that Google's paid-click rate was on the wane - at least in the States. Judging from Google's eventual response, the report wasn't too far from the mark. The search giant acknowledges that paid clicks are down, insisting it's on a mission to improve "the relevance" of its online ads. Over the next several weeks, tech-happy pundits spent countless columns debating the effect of this click dip on Google finances - which turned out to be no effect at all - but nobody stopped to wonder where comScore's data came from. Or why it hit so close to Google's home.

Playboy posts quarterly loss, shares drop.

Adult entertainment publisher Playboy Enterprises Inc posted a quarterly loss on Tuesday because of weaker publishing and domestic television revenue and forecast more trouble during the year, pushing its shares down 8 percent. The worse-than-expected results illustrate the trouble that Playboy and other publishers and television companies face as more people get their entertainment online, and often for free. Its results also show that, at least for Playboy, licensing its bunny ears brand and bachelor lifestyle cachet is proving a more resilient business than the magazine that created them.

Pro Intellectual Property Act Passes House.

The House of Representatives has passed a bill that will create a White House czar for intellectual property rights and also increase resources to fight bootleggers. The Prioritizing Resources and Organization for Intellectual Property Act, known as the PRO-IP Act and supported by a wide coalition of interests that includes the entertainment industry, sailed through on a vote of 411-10 on Thursday. The bill creates a White House position that would coordinate antipiracy efforts of eight federal agencies and also toughens laws against piracy, in addition to increasing resources, particularly at the Dept. of Justice, to go after bootleggers. "Intellectual property protection is among the key issues that will determine America's competitiveness in the 21st century," Rep. John Conyers (D-Mich.), a co-author of the bill, said in a statement. "The ability to create, innovate, and generate the best artistic, technological, and knowledge-based intellectual property is the formula for continued growth in the global economy, and is fundamental to the promotion of human progress."

Windows XP SP3 leaps into the tubes.

Microsoft is giving the automatic web release of Windows XP Service Pack 3 another go today, after an eleventh hour muck-up ruined its scheduled availability last week. The truant XP service pack is ready for download via Microsoft's Download Center or alternatively, Windows Update if using Internet Explorer. Here's the ISO CD image file too for good measure while we're trolling hyperlinks. Microsoft had pulled the mass download last week when it uncovered an incompatibility issue between SP3 and its point-of-sale application, Dynamics Retail Management System (RMS). The issue in question — and they've yet to specify what the problem is — also affects Windows Vista SP1.

Indiana Museum, ACLU Sue State Over Pornography Law.

The Indiana Museum of Art has joined a civil rights group suing the state of Indiana over a law that would require any business selling pornography to register with the state, the Indianapolis Star reports.Aimed at identifying businesses that sell "sexually explicit" material, the law, scheduled to go into effect July 1, would require any business selling anything "harmful to minors" to register with the state and pay a $250 fee. According to the Indiana Code, that would include anything that "describes or represents, in any form, nudity, sexual conduct, sexual excitement, or sadomasochistic abuse" and "lacks serious literary, artistic, political, or scientific value for minors." The suit has been filed by the American Civil Liberties Union of Indiana and attorneys for several national organizations representing sellers of books, CDs, and DVDs. Ken Falk, legal director for the ACLU branch, said the law is vague and overly broad and violates the first amendment. What is harmful to a six-year-old for example, may be fine for a 16-year-old, which means that sellers would have to determine themselves what is harmful, then decide whether to register. Businesses that do not register could be subject to a fine of up to $1,000 and 180 days imprisonment.

Reaction to Proposed Michigan Adult Bookstore.

Residents packed the Clinton County Courthouse to plead their case over a proposed adult bookstore. It would be located on M-100 and Grand River Avenue in Eagle Township. It was a pretty emotional meeting. Extra security and a lot more people than usual were on hand to discuss this hot topic. Because it's an adult bookstore, Clinton County must give the owner a special permit to operate. There was the possibility the planning commission would make a decision on that issue, but they ended up tabling it, saying they need more time to look over the details. That decision angered a lot of residents. Not one person who spoke out at the meeting was in favor of the business, besides the man who's proposing the idea. Business owner: "My business is to supply adult supplies for adults in their homes. My business is not for people to come and hang out. This business does not have live entertainment." Resident: "Anyone in their right mind would never consider such an idea. Those who look at pornography are sick and those who sell pornography are sick."

LimeWire malware hits 500,000 users in a week.

There's a new piece of malware in town and, although not the most harmful code in the West, it sure is getting around. In just seven days this as yet unnamed irritant has hit over half a million computers and bugged the crap out of users everywhere. It works by disguising itself as any old piece of media that when opened will ask you to download a codec that is actually a bundle of adware hell that'll give you the kind of pop-up fever normally associated with the browsing of a thousand porn sites.

Motion-Capture Suits Will Spice Up Virtual Sex.

No matter how beautiful the sex animations are in your favorite virtual playground, they can't compete with the movement of your own body. How soon will we be slipping gracefully into motion-capture suits or using 3-D cameras to capture those uniquely natural moves and engage our entire bodies in online sexual adventures, rather than limping along with keyboard and mouse? Sooner than you might think. Kevin Alderman, who's already infamous for the sex animations his company Strokerz Toyz creates for Second Life, is developing a wireless, consumer-level motion-capture suit that's expected to hit shelves in 2009. "Right now only a dozen or so sites on the web offer downloadable mocap files," Alderman says. "You have to wait until some studio becomes benevolent enough to make the animations you want, or you have to engage them for your specific needs."

Comcast mulling Net usage cap to discourage 'excessive' use.

Comcast Corp., the nation's second-largest Internet service provider, is considering setting an official limit on the amount of data that subscribers can download per month and charging a fee for those who go over. As more consumers download movies and music online, Internet service providers have to grapple with how to manage their traffic so that bandwidth hogs don't slow down the network for the lighter users among the company's 14.1 million subscribers. For years, Comcast directly called customers who used up several times more bandwidth than the typical subscriber's 2 gigabytes per month - for instance, by downloading hordes of movies. The big users were asked to reduce their use or have their accounts canceled.
